The last time the DOL’s EBSA raised the penalties listed in their Enforcement manual was in the 1990’s. In our conversations with the DOL, they have verbally confirmed that those penalties are being increased. Currently, the revised penalties are only being found in the penalty letters that the DOL is issuing out to non-filers. They are not posted online as of the date of this blog. Below are excerpts from recent penalty letters.
Please note: These penalties should not be confused with the DOL’s civil penalties tied to the Inflation Act. For those, please reference the list below. These are updated every year around mid-January.
